Privacy Policy
This Privacy Policy (“Policy”) sets out how Golden Landing Limited ("GLL") collects, uses and handles personal information and data in connection with the use of application service titled GCGlobal ("App") and any other related services managed and operated by GLL (the App and these related services shall collectively be referred to as the “Service”).
"Member(s)" means the persons who have (i) agreed all of the provisions of Terms of Use (which is separately established by GLL) and this Policy, (ii) submitted membership registration application to GLL for approval, and (iii) been approved by GLL to use the Service under the Agreement of Use the Service which is formed by the Terms of Use and this Policy ("Agreement of Use").
If Member(s) use the Service, Member(s) must have agreed and/or shall be deemed to have agreed all of the provisions of Terms of Use and this Policy.
Article 1
“Personal Data” means any information and data that can be used to identify Member(s), directly or indirectly, alone or together with other content. Personal Data includes, without limitation, the followings;
- Name and/or username
- Gender
- Birthdate and/or age group
- Language
- Location and/or address
- Email address and/or other contact information
- Access log and/or history
- Cookie and anonymous ID
- Electronic device information
- Payment and/or bank information when trading goods
- Trading history
Article 2
Member(s) shall agree in advance that when Member(s) do not provide the whole or part of the Personal Data and/or information, GLL may not be able to screen and process concerning Member(s)’ use of the Service, and Member(s) may not be able to use all or part of the Service.
Article 3
GLL shall only collect Personal Data based upon the use of Service and the Personal Data shall not be obtained through any illegal means and/or deceptive acts by GLL.
Article 4
GLL strives to use Personal Data only for the following purposes. Without Member(s)’ consent, GLL shall not use Personal Data for any other purpose which is not set out in this Policy. In addition, Service shall also include online trading, marketing and/or any other business activities provided by GLL;
- to provide, maintain, and improve the Service
- to ensure smooth communications without interruption
- to verify Member(s)’ personal identification and prevent unauthorized use
- to provide notices about the Service and respond to inquiries
- to inform Member(s) about and provide new features and services in connection with the Service
- to notify Member(s) of any change in the Terms of Use or this Policy for the Service
- to notify Member(s) in the event of termination, suspension or cancellation of the Service
- To conduct statistical analysis
Article 5
The duration that GLL uses and/or handles the Personal Data obtained through the Service shall be the longest duration between following three timepoints;
- The timepoint when the Member(s) provide Personal Data to use the Service
- The timepoint when GLL needs to preserve Personal Data in accordance with related laws
- The timepoint when GLL needs to preserve Personal Data in order to execute GLL business
Article 6
The locations that GLL uses the Personal Data obtained through the Service are as follows;
- Registered location of the office of GLL, GLL’s subsidiaries and/or associated companies
- Registered location of the office of any companies or sole proprietors who have the business relationship with GLL
- Registered location of the person(s) who receive the international transmission or any other communication
- Registered location of the seller(s) who has exhibited the items which the Member(s) bought
Article 7
Member(s) shall agree in advance that GLL is authorized by the Member(s) himself/herself/themselves to provide his/her/their Personal Data to other Member(s) and/or third party(s) who have traded with the Member(s) in the Service.
Member(s) shall agree in advance that GLL is authorized by the Member(s) himself/herself/themselves to provide his/her/their username, gender, age group, location, access log and/or trading history to the third party(s) whose products are listed on the Service.
Member(s) shall agree in advance that GLL is authorized by the Member(s) himself/herself/themselves to disclose his/her/their gender, age group, location, access log and/or trading history (without disclosing other Personal Data such as username and email address) to the general public.
Member(s) shall agree in advance that GLL is authorized by the Member(s) himself/herself/themselves to outsource the handling or management of Personal Data, in whole or in part, to one or more independent service provider company(s), upon which GLL shall conduct appropriate monitoring to ensure proper management of the Personal Data.
Article 8
GLL shall not disclose Personal Data to any other Member(s), third party(s) and/or the general public without Member(s)’ consent except in the cases of Article 7 of this Policy. However, in the following circumstances, Personal Data may be disclosed without Member(s)’ prior consent;
- When laws or regulations require GLL disclosing Personal Data based on laws and ordinances
- When it is necessary to protect the life, body or property of an individual, and due to circumstances, and it is difficult to obtain Member(s)’ consent
- When it is necessary for improving public health, or ensuring the well-being of general public, and due to circumstances, it is difficult to obtain Member(s)’ consent
- When it is necessary for cooperating with government agencies, local public bodies, or any agents thereof, in executing the affairs prescribed by laws or regulations, and obtaining Member(s)’ consent is likely to impede the execution of the affairs concerned
Article 9
The manner GLL discloses Personal Data to other Member(s), third party(s) and/or general public in accordance with Article 7 and 8 includes both a method that is automated and a method that is not automated. The manner includes the following method but not limited;
- Document, electronic document, telephone, and facsimile
- International transmission, international communication, telecommunications, and so on
Article 10
By changing the settings on the electronic devices, Member(s) may refuse to accept Cookie and display a warning when Member(s) receive Cookie. However, by changing the setting, the Service may not be available in whole or in part. GLL mainly uses Cookie for the following purposes.
- For customer's usage situation survey
- To make it unnecessary to enter password every time when Member(s) log-in to the Service
- To make the Service more satisfying by improving and customizing the Service according to individual Member(s)’ liking and/or preference
- To provide useful services and advertisements for Member(s)’ interests
- To perform statistical analysis
Article 11
GLL may contact Member(s) via e-mail, postal mail, telephone, etc. in order to provide information on GLL’s services and/or third-party partners’ products and/or services which appear useful to the Member(s). Member(s) can discontinue or restart these handling according to the method separately defined by GLL.
Article 12
Third party(s) redirected from GLL’s Service may collect Member(s)’ information (which may include Personal Data) through their services, marketing and/or business activities. GLL shall not be responsible for any obligations or responsibility concerning the protection of Personal Data in these third parties. For information regarding third party(s)’ handling of information (which may include Personal Data), Member(s) shall refer to the privacy policies and/or terms and conditions separately established by the respective third party(s).
Article 13
GLL reserves the rights to revise this Policy from time to time as GLL considers appropriate. GLL shall announce the changed and/or additional clauses in Policy on GLL’s Service or on GLL’s websites. Member(s) are advised to check the Policy changes from time to time. GLL is not responsible for any damages and/or liabilities caused by the changes and/or additional clauses in Policy.
Article 14
Member(s) may submit a request to retrieve, correct, and/or delete his/her/their Personal Data through the Inquiries window stipulated in Article 15. From the viewpoint of prevention of Personal Data leakage, GLL may retrieve, correct, and/or delete Member(s)’ Personal Data within a reasonable period only if GLL can believe that the request is from the Member(s)’. However, there may be circumstances under which GLL may not be able to accommodate Member(s)’ request, such as when GLL is not required to fulfill Member(s)’ request under the Act or other relevant laws or regulations related to Member(s)’ request, and/or when Member(s) repeatedly make the same requests without justifiable grounds, and/or if such retrievals, corrections, additions or deletions require work by GLL that GLL deems to be excessively technical and/or costly.
Article 15
This Policy shall apply to any and all Member(s) who use this Service.
Rules and additional provisions relating to the collection and handling of Personal Data (hereinafter collectively referred to as the "Individual Provisions") posted and distributed on the Website or service documentation shall form part of this Policy.
If any conflict or inconsistency between the contents of this Policy and the Individual Provisions, Member(s) shall contact GLL at info@gcglobal.com.hk for consultation and/or clarification.
Article 16
If any provision of this Policy or any part thereof is held to be invalid or unenforceable by laws or regulations, the remaining provisions of this Policy and the rest of the provisions determined to be invalid or unenforceable shall remain in full force and effect, and GLL shall endeavour to amend such invalid or unenforceable provision or part to the extent necessary to make it legal and enforceable, and to ensure the purpose of such invalid or unenforceable provision or part and the same legal and economic effect.
Article 17
The provisions which, in view of the nature of Article 5, 6, 7, 8, 11, 12, 13, 14, 15, 16, 17 (i.e. this Article), 18, 19 and the provisions which, by their nature, should continue in full force and effect shall survive the termination and/or cancellation of use of the Service and the Agreement of Use.
Article 18
This Policy shall be governed by and construed in accordance with the laws of Hong Kong.
The English text of this Policy shall be the original text. In the event any translation into any other language is prepared for reference purposes and there are any conflicts between the English text and the translation text, the English text shall prevail to the translation text.
Article 19
Member(s) shall agree that the courts of Hong Kong shall have exclusive jurisdiction to hear and determine any suit, action and/or proceeding, and to settle any disputes which may arise out of or in connection with this Policy and for such purposes irrevocably submit to the exclusive jurisdiction of such courts.
Article 20
Any matter not stipulated in this Policy or any doubtful point raised concerning any provision of this Policy shall be settled after Member(s)’ due consultation in good faith with GLL. please contact GLL from the Inquiries window at info@gcglobal.com.hk.
